What is a trademark?

A trademark is a name, illustration, design, color, sound, or scent that identifies the source of a product used in commerce. A trademark:

A service mark is the same as a trademark but identifies the source of a service rather than a product.

LOGO MARKS

An image or illustration with stylized words, letters, or numbers, or a combination of them, used to identify the source of products or services.

I. Images, such as mascots, emblems, or abstract symbols.

Image marks can work effectively across borders, cultures, and languages. Famous illustration marks can transcend linguistic and cultural barriers, becoming widely recognized brands across different regions and languages.

II. A graphic representation of a name with a stylized word, letter, phrase, or number, or a combination of them.

III. Combination logos include both an image design and stylized words, letters, phrases, or numbers.

COLOR MARKS

I. The mark consists of a color (or colors) used to identify the source of products or services.

Scent Marks

I. The mark consists of a scent used to identify the source of products or services.

Sound Marks

I. The mark consists of a sound used to identify the source of products or services.
